Abstract

According to Iqbal, Ijtehad is the principle of movement in Islam. The social needs of a Muslim society, in context with the time and space, are when brought to some legal framework for a legitimate fulfillment, this procedure is called Ijtehad. Such legislation at individual level is Ijtehad and at collective level is Ijma. This article describes the essential pre-requisites which are necessary for a legitimate Ijtehad and Ijma. The Quran and Sunnah are Divine values while Ijthad and Ijma are human values. It is not possible that the purpose of one value is achieved by the other or vice versa. This article elaborates the limitations and essentials which make the Ijtehad and Ijma acceptable in the dogmatic and legal structure of Islam.
